Legal Profession Act 2009

South Australia remains the last jurisdiction to enact its Legal Profession Act. In early 2009, the bill failed in the Legislative Council (second chamber) due to prorogation. No compromise was reached in an impasse over a dispute over compensation to be paid to clients of a former law firm who allege funds were fraudulently withdrawn from the firm`s escrow account. It was to be hoped that the stalled legislation on the legal professions would be reintroduced, given that, at the time of writing, no timetable had been announced for their resubmission. In March 2009, most of the substantive provisions of the Legal Profession Act 2008 (WA), the Legal Profession (WA) Regulations 2009 and the Legal Profession (WA) Regulations 2009 came into force. Certain provisions, such as those relating to fiduciary accounts and professional development, should be phased in. This table may consist of 1, 2 or 3 parts: «Amendments by regulation» or «Regulation» (italics) lists the provisions that approve the amendments by regulation or regulation in the Council, «amendments not in force» (italics) indicates the amendments that are not in force, and «amendments in force» indicates the amendments that come into force on or after the monetary date indicated in the consolidation of the Act. Table of legislative amendments (3rd edition) (January 1, 2014 – November 2, 2022) The draft Model Laws were conducted largely under the auspices and collaboration of the Standing Committee of Attorneys General (SCAG), culminating in the publication of the second edition of the draft Model Law on the Legal Profession at the end of 2006. Between 2004 and 2008, states and territories (with the exception of South Australia) enacted a legal professions act based on the introduction of model legislation. The focus is on legislative changes made from June 9, 2022 to November 2, 2022.
