Public laws may be available in large library systems or college libraries, often as part of their participation in the Federal Depository Libraries Program (FDLP). In 1986, Congress enacted the Emergency Medical Treatment & Labor Act (EMTALA) to ensure public access to emergency services, regardless of their creditworthiness. Article 1867 of the Social Security Act imposes specific obligations on hospitals participating in health insurance that provide emergency services to carry out a medical screening examination () when a request for examination or treatment of an emergency medical condition (EMC), including active work, is made, regardless of a person`s ability to pay. Hospitals are then required to offer stabilizing treatment to EMF patients.
If a hospital is unable to stabilize a patient within its means, or if the patient wishes to do so, an appropriate transfer must be made.
