SAN SALVADOR, El Salvador – El Salvador`s legislature has passed a law making the cryptocurrency Bitcoin the first country to be legal tender in the country, just days after President Nayib Bukele made the proposal at a bitcoin conference. Although Bukele claims that about 70% of Salvadorans do not have access to traditional financial services, the use of cryptocurrency for remittances around the world is uneven. Converting local currencies to and from Bitcoin often relies on informal brokers, prices are volatile, and buying and selling is a complex process that requires technical knowledge. A month after the passage of the Bitcoin law, more El Salvadorans have Bitcoin wallets than traditional bank accounts. The most popular Bitcoin wallet – the officially government-sponsored Chivo wallet – was downloaded by three million people, «representing 46% of the population. In contrast, only 29% of Salvadorans had a bank account in 2017. [27] The use of the Chivo wallet was encouraged by the government with $30 in seed capital in each Salvadoran`s account. Other Lightning-enabled Bitcoin wallets can be used by Salvadorans instead of Chivo. In addition, many of the nation`s largest gas stations offer a 20-cent-per-gallon discount on gasoline for those who pay through the Chivo app.
[27] A month later, 12% of Salvadoran consumers used cryptocurrency, but 93% of businesses surveyed said they had not received payments in Bitcoin in the first month. [28] In an August 2021 poll by Salvadoran newspaper La Prensa Gráfica, a majority of respondents said they were against the Bitcoin law, and nearly three-quarters of respondents said they did not accept Bitcoin as payment. [22] The coastal village of El Zonte has been conducting an active experiment on the use of bitcoin in the local economy since 2019, where some workers have received their wages and can pay their bills in bitcoin, and others use it to buy food and other goods in local stores. [9] [10] In its November 2021 update, the Library of Congress identified 42 countries with implicit bans on certain cryptocurrency uses. Some of the countries it lists are: Bitcoin exists in a deregulated market, so there is no central issuing authority. Bitcoin addresses do not require Social Security Numbers (SSNs) or other personal information such as standard U.S. bank accounts. This initially raised concerns about the use of Bitcoin for illegal activities. Its use as legal tender will begin in 90 days, with the Bitcoin-dollar exchange rate set by the market. Bukele said the government and central bank do not currently hold bitcoins. Bukele, 39, had announced the decision in a recorded message broadcast at a Bitcoin conference in Miami on Saturday. Creating or mining Bitcoin requires a lot of energy, so mining only makes sense in places where electricity is cheap. «If you go to a McDonald`s or whatever, they can`t say we`re not going to take your bitcoin, they have to take it by law because it`s legal tender,» Bukele said in an online conversation he had alongside the congressional debate with representatives of the cryptocurrency industry. In emerging markets, Bitcoin`s legal status still varied widely. China has severely restricted bitcoin without actually criminalizing the holding of bitcoins. India has banned banks from trading Bitcoins, leaving the general legal status of cryptocurrencies unclear. In general, it is necessary to look at Bitcoin laws in some countries. Cryptocurrency theoretically offers a fast and inexpensive way to send money across borders without relying on remittance companies, which are typically used for such transactions. It is not clear what proportion of remittances to El Salvador are in Bitcoin. The use of bitcoin will be optional for individuals and would pose no risk to users, Bukele said, with the government guaranteeing convertibility to dollars at the time of the transaction through a $150 million trust created at the country`s development bank, BANDESAL. This requirement applies only to debts owed to creditors.
The ability to decline a transaction, money, or any other legal tender is explicitly stated on the websites of the U.S. Treasury, which is responsible for printing paper money and minting coins, and the Federal Reserve, which is responsible for distributing money to the country`s banks. El Salvador is the first country in the world to adopt Bitcoin as legal tender after its Congress approved President Nayib Bukele`s proposal to adopt cryptocurrency to promote «financial inclusion,» investment, and economic development. This has led to protests and skepticism from economists and others. As a result, El Salvador`s president, Nayib Bukele, tweeted in August that companies were not obligated to accept Bitcoin. Canada maintains a generally supportive position for bitcoin, as its southern neighbour, U.S. bitcoin, is considered a commodity by the Canada Revenue Agency (CRA) for income tax purposes. This means that any income from a transaction with Bitcoin is considered business income or capital gain and must be reported as such. The new law came into force on September 7, 2021.
[5] In the first hours after the law came into force and the official introduction of new technologies to deal with a major change in the national monetary infrastructure, the government had to take its Bitcoin e-wallet, Chivo, offline due to excessive load. [22] The Bukele government increased server capacity and brought the e-wallet online around noon. [5] On September 7, 2021, Bitcoin plunged to its lowest level in nearly a month, resulting in a paper loss of $3 million. The Salvadoran government attempted to correct this by buying Bitcoin, which allowed the price to exceed $52,000. [25] Due to concerns over Bitcoin`s volatility, more than 1,000 protesters gathered outside El Salvador`s Supreme Court to protest the law. Chivo was initially rejected by many platforms from day one, but was increasingly accepted by them. [26] The European Union recognizes Bitcoin and other cryptocurrencies as crypto assets. At a conference for Bitcoin in Miami in June 2021,[11] President Bukele announced that he would enact a law allowing Bitcoin as legal tender, claiming that it would «create jobs and help provide financial inclusion to thousands of people outside the formal economy.» [12] According to Bukele, the law targets about 70% of Salvadorans without a bank account and will increase their inclusion. [6] Bukele argued that the legislation would increase investments and reduce fees for ongoing money transfer services. [13] To enforce the law, Bukele cooperated with Strike, a financial services company[12] that uses the Lightning Network for resolution,[14] and Jack Mallers, its CEO. [9] [13] In the US, the Internal Revenue Service (IRS) has shown increasing interest in Bitcoin and has issued guidelines. In 2014, the agency issued IRS Notice 2014-21 to provide information on the tax treatment of virtual currencies. Virtual currency is the term used by the IRS for cryptocurrency. For 2020, the IRS added a question on the first page of Form 1040 requiring taxpayers to indicate whether they are involved in virtual currency transactions. It wasn`t immediately clear how long Bukele had been working on the Bitcoin plan, but he said Wednesday that he was inspired by a project called Bitcoin Beach, which launched the cryptocurrency last year in a beach town in El Salvador. The peer-to-peer digital currency Bitcoin debuted in 2009, introducing the concept of decentralized funding to the world. While tax authorities, law enforcement agencies, and regulators around the world are still debating how to control it, many consumers are wondering if they can legally use Bitcoin. Bukele, a former marketing executive, suggested that bitcoin could make it easier to send remittances to Salvadorans living abroad, which totaled $6 billion in 2019, or one-fifth of the country`s GDP.
