She added that there must be interviews with auditors after each audit so that data can be gathered on the challenges auditors have encountered in assessing audits. The Chair of the Legal Education Forum of the Council of Legal Practice (LPC), Busani Mabunda, told a delegates` meeting on 14 July 2022 that the purpose of the LPC Legal Education Forum meeting is for stakeholders to be accountable for what they do to ensure access to the profession. He added that it is the LPC`s duty to ensure that the objective of ensuring access to the profession is met and that the LPC is accountable to Parliament for the extent remaining to it to ensure that it has achieved its objectives, such as ensuring access to the legal profession through board audits. Melissa Murray, Senior Manager of Education and Training at LPC, provided statistics on the success rate of board audits for the 2021 and 2022 periods. Mabunda tasked LSSA`s acting chief executive, Anthony Pillay, with some of the things the LSSA was supposed to investigate, including the cost of legal training and exams. The LSSA responded that it operates on a cost basis and that if the costs of the LSSA are found to be excessive or inefficient, this could be addressed by competition.
The LSSA is not anti-competitive, even though it was an existing accredited provider. In addition, many new suppliers have been accredited. The revised review procedure presented by the LSSA with input from the LSSA Executive Committee was noted and will be discussed in the Education Committee. Mr Pillay told the Assembly that the LSSA was undoubtedly fully committed to transformation and access to the profession. He cautioned that changes in the legal education model need to be properly researched and considered based on costs, including oral exams. Complaints against lawyers are handled by the provincial offices of the Legal Practice Council, depending on where the lawyer works. The Council of Legal Practice is a national statutory body established under Article 4 of Law No. 28 of 2014 on Legal Practice. The Council of Legal Practice and its provincial councils regulate matters and exercise jurisdiction over all legal practitioners (lawyers and lawyers) and trainee lawyers. The LPC expressed concern that it had spent R70 million on legal education, but the results of the council`s audits deteriorated. During the discussion, the general opinion was that many candidates were not fully prepared and that the use of previous exam papers gave candidates a false impression of preparation. The Legal Practice Council and the Legal Education Forum held a stakeholder meeting in Gauteng on 14 July 2022. Mabunda said Article 5(h) of Law 28 of 2014 on Legal Practice states that LPC shall promote high standards of legal education and training.
